Vayvio Terms of Use

These Terms of Use govern your access to the Vayvio website and application.

By creating an account or using Vayvio, you agree to these Terms. If you do not agree, do not use the service.

1. About Vayvio

Vayvio provides wellness features that may include:

• soundscapes for focus or relaxation;
• guided relaxation or meditation sessions;
• journaling;
• personal activity history and insights;
• optional notifications.

Vayvio is currently provided free of charge.

Any future donation option, paid feature or separate service will be presented with appropriate information before you choose to use it. No charge will apply retroactively.

2. Eligibility

You must be at least 15 years old to use Vayvio.

If you have not reached the age of legal majority where you live, you may use Vayvio only with the permission of a parent or legal guardian. Your parent or guardian must review these Terms and the Privacy Policy with you.

Where applicable law requires verified or joint parental consent, you may not create or use an account until that consent has been obtained.

By creating an account, you confirm that you meet these requirements.

3. Wellness service, not medical care

Vayvio is designed for general wellness, relaxation, focus and personal reflection.

Vayvio:

• is not a healthcare provider;
• does not provide medical or psychological advice;
• does not diagnose, treat, cure or prevent any condition;
• is not a substitute for qualified professional care;
• is not an emergency or crisis-support service.

Do not rely on Vayvio when urgent assistance is required. Contact local emergency services or an appropriate qualified professional.

Stop using a soundscape, exercise or guided session if it causes discomfort, distress or makes you feel unsafe.

4. Your account

Vayvio uses a magic link sent to your email address. You are responsible for:

• providing an email address you are authorised to use;
• protecting access to your email account and device;
• not allowing another person to use your account;
• notifying Vayvio if you believe your account has been compromised.

You may delete your account through the application.

We may suspend or close an account where reasonably necessary to protect users, secure the service, comply with law or address a serious breach of these Terms.

5. Journaling and your content

You retain ownership of the journal entries and other original content you create.

You give Vayvio a limited, non-exclusive permission to host, store, back up, reproduce and display that content only as necessary to operate the service for you.

Vayvio does not claim ownership of your journal entries and does not use them for advertising, sale, artificial intelligence training or research.

Although access controls are used, limited technical access may be possible for authorised infrastructure personnel when strictly necessary for security, maintenance, recovery or legal compliance. No online storage system can guarantee absolute confidentiality or availability.

You are responsible for your content and should not use Vayvio to store content that:

• is unlawful;
• infringes another person’s rights;
• contains malicious code;
• is intended to abuse, threaten or harm another person;
• interferes with the operation or security of the service.

Keep a separate copy of any journal entry or other information you cannot afford to lose.

6. Acceptable use

You must not:

• attempt to access another person’s account or data;
• bypass authentication, permissions or security controls;
• probe, scan or test the service for vulnerabilities without written permission;
• introduce malware or harmful code;
• overload, disrupt or damage the service;
• scrape or systematically extract content or data;
• reverse engineer the service except where applicable law expressly permits it;
• use Vayvio in violation of applicable law.

7. Notifications

Notifications are optional and require permission from your browser or device.

You are responsible for deciding whether notifications are appropriate for your circumstances. You may disable them at any time.

Delivery is not guaranteed and may depend on your browser, device, operating system, network connection or third-party notification infrastructure.

8. Intellectual property

Except for user-created content, Vayvio and its associated software, design, text, audio, soundscapes, graphics, branding and other materials are owned by or licensed to Vayvio and are protected by applicable intellectual-property laws.

Vayvio grants you a limited, personal, non-exclusive, non-transferable and revocable right to use the service for your own lawful purposes.

You may not copy, distribute, sell, publicly perform, sublicense or commercially exploit Vayvio content unless expressly authorised or permitted by law.

9. Beta service and availability

Vayvio may be released as a beta or developing service.

Features may change, contain errors, be interrupted or be removed. We do not guarantee that:

• the service will always be available;
• every feature will work on every device;
• notifications will always arrive;
• stored information will never be lost;
• soundscapes or guided sessions will produce a particular result.

We may modify, suspend or discontinue all or part of Vayvio. Where reasonably possible, advance notice will be provided for material changes.

10. Third-party services

Vayvio relies on third-party infrastructure, including Supabase and Vercel.

Third-party services may experience interruptions or operate under their own terms and privacy policies. Vayvio is not responsible for third-party services outside its reasonable control.

11. Disclaimer

Vayvio is provided on an “as available” basis.

To the fullest extent permitted by law, no guarantee is made that Vayvio will be uninterrupted, error-free, completely secure or suitable for a particular purpose.

Nothing in these Terms excludes warranties, remedies or consumer rights that cannot lawfully be excluded.

12. Limitation of liability

To the fullest extent permitted by applicable law, Vayvio and its operator will not be liable for indirect, incidental, consequential or unforeseeable losses resulting from:

• reliance on wellness content;
• interrupted or unavailable service;
• notification failure;
• loss of journal content or other data;
• unauthorised account access outside Vayvio’s reasonable control;
• incompatible devices, browsers or third-party services.

This limitation does not apply to fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot legally be limited.

Your mandatory rights under applicable consumer law remain unaffected.

13. Ending your use

You may stop using Vayvio and delete your account at any time.

Account deletion removes associated content from active systems, subject to short-term backup retention, security records and information that must be retained by law.

Provisions that by their nature should continue after account deletion, including intellectual-property, disclaimer, liability and dispute provisions, will remain in effect.

14. Changes to these Terms

We may update these Terms to reflect changes to Vayvio, applicable law, security requirements or service providers.

Material changes will be communicated through the website, application or another appropriate method. Continuing to use Vayvio after the updated Terms take effect means you accept them, except where applicable law requires a different form of consent.

15. Governing law and disputes

These Terms are governed by French law.

However, if you are a consumer living outside France, you retain any mandatory protections provided by the law of your country of residence. Nothing in these Terms requires you to give up a right or legal forum that cannot lawfully be waived.
